Dividing a new building into flats

Six steps from the design to flats entered in the land register: separate units in the design, building permit, construction and supervision, use permit, recording the building and the division plan.

Guide · Updated

1. Dividing into flats starts in the design

Every flat you are going to sell must be a self contained unit: with its own entrance, space for sleeping and cooking and a separate bathroom. Besides a flat, a separate unit can be a commercial space, a garage or a clearly marked parking space in the building.

A flat can come with ancillary parts: a balcony, a terrace, a storage room in the basement or attic, a garden and up to two parking spaces. They must be clearly separated and reachable from the shared parts or from the flat itself. The staircase and other parts that serve everyone cannot belong to one flat. That is why we lay out the separate units already in the design, not after construction.

If the building is built to a plan of separate units confirmed by the building permit, the use permit replaces the separate certificate that the flats are self contained units.

2. The permit application for a multi unit building

An application for a multi unit residential building comes with the main design, the energy and acoustic performance certificates of the building, proof of legal interest and a list of the flats with data on their housing quality.

The building authority issues the permit once it finds that the main design complies with the spatial plan, that the special and connection conditions have been set and that the accessibility regulation has been applied. The permit and the list of flats also go to the cadastre office.

With the application

  • Main design of all disciplines
  • Energy performance certificate of the building
  • Acoustic performance certificate of the building
  • Proof of legal interest
  • List of the flats
  • Design review report, where a review is required

3. Notice of start of works and construction supervision

At least five days before works begin, the investor files the notice of start of works electronically. It names the contractor and the supervising engineer and includes the certified setting out survey, where one is needed.

Construction supervision is the investor's duty, and the supervising engineer may not be an employee of the contractor. When several engineers supervise, the lead supervising engineer writes a final report at the end, which is needed for the use permit. We no longer do construction supervision, you choose the supervising engineer.

Changes during construction that alter the location conditions need an amended building permit. A change in the flat layout also changes the separate units, so tell the designer before it is built.

4. Technical inspection and use permit

The building may be used only once the building authority has issued the use permit. Before that, a technical inspection checks that the building was built according to the building permit and the main design.

The investor and the public bodies that set special conditions are invited to the inspection. The investor must make sure that everyone involved in the construction attends and must present the required documents.

With the use permit application

  • Building permit and details of everyone involved in the construction
  • Contractor's statement on the works and the maintenance programme
  • Final report of the supervising engineer
  • Statement of a licensed surveyor on the position of the building on the plot
  • Survey of the building as built
  • Energy certificate of the building
  • Proof of proper disposal of construction waste

5. Recording the building in the cadastre and the land register

Once the use permit is enforceable, the building authority sends it with the survey to the cadastre office electronically. The investor can also apply to have the building recorded in the cadastre.

The cadastre then notifies the land register court, which enters the building of its own motion and adds a note that the use permit was submitted. Without that note, the building is considered not to have proven its fitness for use.

6. The division plan and registering the flats

The division plan (etažni elaborat) divides the building into separate units and gives each a co ownership share. Usable area is as a rule taken from the main design, and open balconies, terraces, stairs and storage rooms unfit for living are not counted. We prepare the division plan and coordinate the survey part with the surveyors we work with.

The owner of the land with the building can, by a declaration to the land register court, divide the ownership into co ownership shares and attach a particular flat to each. This can be done even before construction, but ownership of a flat arises only once the building is built. The application for registration is filed electronically through a Croatian notary or attorney.

In the land register each co ownership share is entered with its flat and the ancillary parts, and the folio is marked as condominium ownership (Etažno vlasništvo). From then on each flat, together with its share, is sold and mortgaged separately.

Questions about dividing a building into flats

Can flats be sold before construction is finished?

The owner of the land can divide the ownership into co ownership shares and link them to future flats even before construction. Ownership of a flat is established only once the building is built and the legal conditions are met. Contracts with buyers should be drawn up by an attorney or a notary.

What if the area of a flat changes during construction?

If the useful value of a flat set before construction ends changes by at least 2 % through works that need a permit, a new determination can be requested. The request must be made within one year after the use permit becomes final.

Can a parking space belong to a flat?

Yes, as an ancillary part of the flat, up to two spaces per flat, if they are clearly separated. A garage or a clearly marked space in the building can also be a separate unit of its own.

I invest from abroad. What has to be done in Croatia in person?

The design and the permit can be handled without a meeting: for the permit application the only document you sign is a power of attorney, certified by a notary or at a Croatian consulate. Applications to the land register are filed electronically through a Croatian notary or attorney.

Do you do construction supervision and the land register entry?

No. We design the building, prepare the division plan and coordinate the survey part. The investor chooses the supervising engineer, and a notary or attorney files the application with the court.
